Terms and Conditions

1. Definitions

   1. Tea Adventure: the trade name of this company.
   2. Buyer: any natural or legal person who has or will enter into a contractual relationship of any kind with Tea Adventure.
   3. Products: the subject of one or more agreements.
   4. Website: www.tea-adventure.com.

2. Relevance

   1. These Terms and Conditions apply to all offers of tea and tea ware Tea-Adventure offers.
   2. In addition to these terms there may be expressly stated additional requirements which apply to certain services and / or products. If there are any differences between the Additional Terms and Conditions and those stated here, then the provisions of the Additional Terms and Conditions will take precedence unless otherwise specified.
   3. One or more of the provisions of these terms may only be waived if expressly agreed to in writing. In this case the remaining provisions of these terms remain in full force.
   4. Any conditions put forth by the buyer shall not apply unless expressly authorized in writing by Tea Adventure.
   5. The web site of Tea Adventure focuses on the Dutch market.
   6. Tea Adventure reserves the right to amend the Terms and Conditions and / or the supplemental Terms and Conditions.
   7. By using the web site of Tea Adventure and / or placing an order, the purchaser accepts these terms and any other conditions and obligations stated on the website.
   8. Tea Adventure is authorized to make use of third parties in the implementation of an agreement with the buyer.

3. Offers and Contracts

   1. Offers are valid while stocks last unless otherwise indicated.
   2. A personalized quote is valid for two (2) weeks, unless a different period is stated in the offer.
   3. A purchase by the prospective buyer is deemed to be made in one of the following circumstances:
          * The potential buyer has the data entered in the appropriate input screen of the website and the relevant data ("order") is sent to and received by Tea Adventure through electronic means.
          * The potential buyer has expressly indicated a particular product and / or service that they wish to purchase through telephone or e-mail
          * A tender is signed by the buyer and once received by Tea Adventure a personalized quotation has been released.
   4. An agreement is established when an order confirmation has been sent to the seller from the buyer by email. This agreement may be revoked by Tea Adventure in the event the buyer does not meet the requirements of the agreement or has failed to meet such requirements in the past. In this case, Tea Adventure will notify the buyer within ten (10) days after receipt of the order.
   5. The buyer and Tea-Adventure expressly agree that electronic communication constitutes a valid agreement that is concluded as soon as the conditions in Article 3.3 and 3.4 are met. In particular, the lack of a signature does not affect the binding nature of the agreement and its acceptance. The electronic files of Tea Adventure apply here, where the law allows, as a presumption of proof.
   6. The buyer is entitled to cancel an order from Tea Adventure.
   7. Information, images, oral communications, statements, etc. regarding all the offers and the main features of the products through internet sites, telephone or e-mail will be provided as accurately as possible. Tea Adventure does not guarantee that all offers and products will be profided with a full warranty. Deviations to the agreement cannot lead to compensation and / or dissolution.

4. Prices and Shipping

   1. All prices are expressed in euros, in line with legal regulations, and include tax.
   2. The buyer will be charged in accordance with Article 3.4 of these Terms and Conditions. Obvious mistakes in the price, such as errors after the completion of the agreement, will be corrected.
   3 All orders with a total value of less than 15.00 euros will be subject to a 4.00 euro shipping charge. For orders over 15.00 euros, shipping will be free.
   4. If the prices of the products and services increase in the period between the order and the execution thereof, Tea-Adventure will charge the price for all items at the time the order was valid.

5. Payment

   1. Orders through the website can be paid in the following ways:
          * Prepayment
          * IDeal
          * PayPal
          * Credit Card
     Any changes to the payment options will be made known through the website.
   2. The total order amount is due within ten (10) days of the order. If no payment has been received after this period, the order will be canceled by Tea Adventure.
   3. When paying with a credit card (via PayPal) the conditions of the credit card company apply.

6. Discount Codes

   1. Any discounts will be posted in the newsletter or with the product.
   2. Discount codes are only valid for the stated product. If an active discount code is used for a separate product, the customer should pay remaining balance or Tea Adventure reserves the right to cancel the order.

7. Delivery and Delivery Times

   1. Orders will be delivered as soon as possible. Tea Adventure aims to send orders within 24 hours of receiving full payment. Since the products are sent directly from China, we expect orders to arrive within 4 days by express delivery, 12 days by normal shipping and 2 months by ship. If in stock, we will seek to send orders within 24 hours of receipt of full payment. When ordering 500 grams or more of TieGuanYin, we will provide express shipping to guarantee freshness.  The above mentioned delivery times are estimations, therefore delivery times may vary due to situations beyond our control.
2. In principle, all products shown on the Tea Adventure website will be in stock. However, stock levels will vary so it is possible that multiple orders might cause an item to be "temporarily sold out".
   3. Orders will only be delivered once they are completely in stock. Buyers shall be immediately informed of their order status after completing an order.
   4. The Tea Adventure website provides expected delivery times. The expected delivery times are based on information from our suppliers and are only an estimate. Actual delivery times may vary and any times shown on this website are not legally binding.
   5. If an ordered product is temporarily out of stock, the buyer will be notified when the product becomes available.
   6. Deliveries will be made by the buyer during the formation of the contract address.
   7. Once the items arrive to the specified delivery address, responsibility for the products passes to the buyer.
  8. If an order is delivered in parts, then Tea Adventure will consider each transaction as an individual transaction.
  9. If items ordered and paid for are not in stock, Tea Adventure will inform the buyer as soon as possible. In this case the buyer has the right to cancel the order.
  10. In order to receive a refund, the Buyer must return the purchased items within the agreed upon time frame.If the buyer fails to return the items, Tea Adventure is entitled to dissolve the agreement without declaring judicial intervention, according to Article 6:60 of the Civil Code.

8. Cooling, Revocation and Ruling

   1. The buyer may return items or cancel orders within seven (7) days after delivery of the product without penalty and without giving any reasons. This excludes products whose seal (seal) is broken.
   2. In the event of a cancellation, the buyer shall receive a refund within 7 days after the  returned product has been received by Tea Adventure. The costs of returning the product are borne by the buyer.
   3. If the buyer invokes the right to return items as stated in Article 8.1,Tea Adventure shall ensure repayment within 14 days through a bank transfer.
   4. Tea Adventure is not liable for any damage, theft or loss, including retuned packaging or products.
 

9. Warranty and complaints

   1. 100% MONEY BACK GUARANTEE. If you are not satisfied you can return products. We guarantee a full refund including the transportation costs!
   2. If a product delivered within the warranty period is defective, the buyer may contact Tea Adventure.
   3. The buyer shall carefully inspect all products immediately upon receipt. Complaints from the buyer relating to product defects or delivery should be reported to Tea Adventure within 7 days of delivery. Please provide the confirmation email with the delivery date and the track & trace code specified.
   4. All images, photos, drawings, etc., including information on weight, dimensions, colors, graphics, labels, etc. on the web site of Tea Adventure are only approximations, and thus may not lead to damages or rescission of the contract .
   5. Buyers will have the rights set out in Book 7, Title 1, Sections 1 to 7 BW included.
   6. If you have any complaints about the services of Tea Adventure or any of its products please contact Tea Adventure’s customer service.

11. Liability

   1. Tea Adventure is never obliged to pay any compensation to the buyer or other parties, except in cases of intent or gross negligence. Tea Adventure accepts no liability for consequential damages, indirect damages to profits or turnover.
   2. If Tea Adventure, for whatever reason, is obliged to compensate any loss, this compensation will never exceed an amount equal to the invoice value of the product or service on which damage was caused.
   3. It is possible that the Tea Adventure website will provide links to other internet sites that may be interesting or informative for the visitor. Such links are purely informative. Tea Adventure is not responsible for the content of the websites referred to or the use thereof.

12. Force Majeure

   1. If Tea Adventure is unable to meet its obligations due to force majeure, Tea Adventure is entitled to suspend its obligations for the duration of the circumstances.
   2. Force majeure includes any circumstance beyond to the control of Tea Adventure causing services and obligations to be wholly or partially restricted. These circumstances include strikes, fires, business disturbances, power failures, failures in (telecommunications) network  connections or communication systems and / or the loss of internet/website services, or late delivery by suppliers or other third parties.

13. Intellectual Property

   1. The buyer acknowledges all intellectual property rights regarding the information, communications or other expressions concerning the products and/or website of Tea Adventure, its suppliers or other claimants.
   2. Intellectual property includes patents, copyrights, trademarks, designs and design rights, and/or other (intellectual property) rights, including technical and/or commercial know-how methods and concepts, whether they are patented or not.
   3. The buyer is prohibited from using and/or changing the intellectual property rights as described in this article. This includes reproduction without the express prior written consent of Tea Adventure, its suppliers or other claimants unless this is private use of the product itself.

15. Personal

   1. Tea Adventure ensures that buyer information will be used exclusively in accordance with the privacy policy.
   2. If you place an order with Tea Adventure, your data will be included in the customer database. Tea Adventure abides by the Data Protection Act and will not provide your information to third parties. For more information please see our Privacy Policy.
   3. Tea Adventure respects the privacy of the users of the website and ensures the confidentiality of your personal information.
   4. In some cases Tea Adventure will make use of a mailing list. Each mailing includes instructions on how to remove yourself from the list.
 

16. Applicable Law and Jurisdiction

   1. All offers and agreements are subject to Dutch law.
   2. The applicability of the Vienna Sales Convention is expressly excluded.
   3. All disputes relating to or arising from Tea Adventure offers, or agreements between Tea Adventure and the buyer will be presented to the competent court in Assen, unless the law specifically designates another judge as competent.

17. Miscellaneous Provisions

   1. Tea Adeventure is part of Tea Adventure Ltd Hong Kong.
   2. Tea Adventure is based in Room 1302, 13F, CRF Building, 303 Henessy Road, Wanchai Hong Kong
   3. Tea Adventure customer service is available on weekdays between the hours of 9.00 and 18.00 at 020-629992 ext 922.
   4. Tea Adventure strives to reply to incoming e-mails within two business days.
